Terms of Use and Sales Agreement

General Terms of Use of the Site

The general terms of use of the site, the general rules, and legal responsibilities related to it are contained in the User Agreement, which includes the terms, rules, and legal obligations specified below. It is recommended that the User Agreement be read before using ackelectronic.com. By using the site and completing the membership form containing your personal information, you are deemed to have accepted the conditions written on these pages. ackelectronic.com reserves the right to update the content of this legal notice page at any time and advises its users to visit the legal notice page each time they access the site.

Usage and Security Rules

ackelectronic.com is open to all members. Unless otherwise stated, the services provided on the site are free of charge. In the following cases, the site administration may block the user’s use of the site and reserves the right to pursue legal remedies against the person(s) involved in these attempts:

1.a. Registering false, irregular, incomplete, and misleading information on the site, including expressions not in accordance with general moral rules or contrary to the laws of the Republic of Turkey.

1.b. Unauthorized copying of the site content in part or in whole.

1.c. The user is solely responsible for any damages resulting from sharing user-specific information such as username, password, etc., provided to them or determined by them, with third parties or organizations (the use of this information by others). Likewise, the user may not use another person’s IP address, email address, username, or personal information on the internet, nor may they access or use other users’ private information without permission. The user is deemed to have accepted all legal and criminal liability that may arise from such use.

1.d. Using software that may threaten the security of the site, preventing the functioning of the site or the software used, attempting such activities, or obtaining, deleting, or modifying information.

Use of Content

2.a. All domain names, logos, icons, demonstratives, written, electronic, graphic, or machine-readable technical data presented, the applied sales system, business method, and business model, including all materials (“Materials”) within the content of ackelectronic.com, and the intellectual and industrial property rights related to them, belong to or are licensed to ackelectronic.com and are legally protected. Unless otherwise stated, they cannot be used for commercial or personal purposes without permission or attribution. Publishing any element of this site in another medium or website without the permission of ackelectronic.com is prohibited.

2.b. The rights of the software used in the design of these pages and the creation of the database belong to ackelectronic.com. Copying or using the mentioned software is strictly prohibited.

2.c. All rights to criticisms submitted to ackelectronic.com belong to ackelectronic.com and may be used for marketing purposes if desired.

Responsibilities

3.a. Information about users visiting ackelectronic.com (duration of visit, time, pages viewed) is tracked for the purpose of providing better service. This information is shared with companies we cooperate with, for advertising and similar purposes, in compliance with privacy conditions, to expand and improve the content. The aim here is to improve the experience offered to users and to enhance ackelectronic.com.

3.b. A ackelectronic.com user may begin using the site after filling out the necessary registration sections, confirming their email address, and agreeing to the conditions stated in this agreement by entering their email address and password.

3.c. While using ackelectronic.com and its services, the user agrees to comply with the Turkish Penal Code, Turkish Commercial Code, Law on Intellectual and Artistic Works, Decrees on the Protection of Trademark and Patent Rights, and other applicable laws, announcements, and notices. All legal, criminal, and financial responsibilities arising from contrary use belong to the user. Users are fully responsible for the copyright and license rights of images sent for engraving to ackelectronic.com. ackelectronic.com reserves the right to publish the images you send for engraving, and customers cannot claim any rights over the submitted images. By sending an image, the user accepts and declares:
"The commercial license and reproduction rights of the image, design, or text I send belong to me. If, for any reason, the license holder of the design I use contacts ackelectronic.com, it will be forwarded directly to me. Using a design protected by third-party copyright is a serious offense and carries severe penalties. For such issues arising from myself, ackelectronic.com E-Commerce Industry and Trade Ltd. Co. reserves the right to pursue all legal remedies."
Images listed on the ackelectronic.com website are the result outputs of vector drawings sent by customers. If copyright owners believe their image has been published on ackelectronic.com, they should submit a removal request along with copyright/license documents to info@ackelectronic.com.

3.d. If it is determined that the user has failed to comply with the obligations specified in this agreement or the general rules announced on ackelectronic.com, their use of the site may be temporarily or permanently suspended and/or their account may be terminated.

3.e. The user may not engage in activities that prevent or hinder other users or visitors from using ackelectronic.com, may not overload/lock servers or databases with automatic programs, or attempt fraud. If detected, their membership will be terminated, and they accept all legal and criminal liability.

3.f. The user may not delete or remove copyright, trademark, or intellectual property law notes from any material copied or printed from ackelectronic.com.

3.g. Membership cancellation and account deletion can be carried out by the user through ackelectronic.com. Once membership is terminated, site access authorization will be revoked. Users who terminate their membership accept that this process is irreversible.

3.h. Whether to delete all records of a terminated account rests solely with ackelectronic.com. The user cannot claim any rights or compensation regarding deleted records.

3.i. Relationships between site users and third parties are their own responsibility.

3.j. ackelectronic.com may contain links or references to other websites not under its control. ackelectronic.com is not responsible for the contents of these sites or the links they contain.

3.k. Subject to terms of use, privacy principles, and applicable laws, ackelectronic.com reserves the right to use all information linked to your account for its own marketing activities.

3.l. In certain sections of the site, different rules and obligations specific to that section may be stated. Individuals and organizations using these sections are deemed to have accepted the specified rules in advance.

3.m. To learn about the precautions we take to protect our users’ personal information and privacy and our general policies on this matter, please read the “Privacy Policy” section.

By using the service, the user is deemed to have accepted all provisions of this participation agreement from the moment they begin. The user agrees to fully compensate ackelectronic.com for any damages arising from their actions contrary to the obligations they have undertaken with this agreement. ackelectronic.com reserves the right of recourse to the user for any compensation and/or administrative/judicial fines it may have to pay to public institutions and/or third parties due to the user’s breach of contract.

Rights and Obligations of ackelectronic.com

4.a. ackelectronic.com accepts and undertakes that the user will benefit from the contracted services, except in cases of technical failures, and that information other than personal data shared by the user will not be shared with third parties or organizations, except for legal obligations. If it is determined that the user engages in any electronic sabotage or attack intended to interfere with the functioning of ackelectronic.com, or if an official complaint or investigation request regarding the user is received from authorities, ackelectronic.com has the right to investigate and disclose the user’s identity information.

4.b. To ensure continuity of the services it undertakes, ackelectronic.com may unilaterally make changes to this agreement without notice. ackelectronic.com reserves the right to suspend, change, or cancel its services permanently or temporarily without providing any reason. The user accepts this right. In case of changes, the updated terms of use will be published under the same link with the new date update and, if deemed necessary, will be notified to users by email. The renewed terms will become effective as soon as they are published on ackelectronic.com, and from that moment on, the use of the site or services will be subject to the renewed terms.

Membership of a user who sends materials contrary to this agreement to ackelectronic.com may be unilaterally terminated without notice.

Enforcement of the Agreement

By filling out and confirming the registration form, or by using this system to receive any service or place any order, the user is deemed to have committed to comply with the agreement of ackelectronic.com. The agreement will automatically terminate without the need for any notice if the membership ends or if any of the termination cases listed in this agreement occur.

Competent Court and Resolution of Disputes

Marmaris Courts and Enforcement Offices have jurisdiction for disputes that may arise from the implementation of this agreement.

Notification Addresses

7.a. ackelectronic.com does not require users to provide postal addresses in advance. However, the email address provided by the user to ackelectronic.com will be considered the legal address for all notifications regarding this agreement.

7.b. Unless the parties notify each other in writing within three (3) days of changes in their email addresses, requests made to old email addresses will be valid and deemed to have been made to them.

7.c. Any notification made by ackelectronic.com using the user’s registered email address will be deemed delivered to the user one (1) day after being sent by ackelectronic.com.

The user declares, accepts, and undertakes that they have read, understood, and accepted all provisions of this participation agreement and that the information they provided about themselves is accurate.
